Feb. 2025 Update on Medicaid Estate Recovery

We previously reported on a Bill in Congress introduced in the House of Representatives by Chicago area Representative Jan Schakowsky.  Her Bill would have ended Medicaid Estate Recovery.  With the Trump administration it will continue.

Yes. You can lose your home if you receive Medicaid after age 55.

A taxpayer over 55 who incurs a long term care condition such as Alzheimer’s or disabling long term care condition can lose their home if they receive Medicaid long term care benefits.  For example the Michigan Medicaid programs included are: hospital; nursing home in-home Medicaid Waiver. While a recipient is in these plans ALL payments Medicaid makes for hospital, ambulance, prescriptions, etc. are subject to payback and Medicaid Estate Recovery.
